SellByChat.ai ("we," "us," or "our") provides an customer engagement platform designed for fitness coaches, creators, and businesses ("the Service"). By accessing or using the Service, you agree to be bound by these Terms of Service.

If you do not agree to these terms, do not use the Service.

SellByChat.ai helps businesses manage customer conversations across Instagram and Facebook Messenger. Our Service connects to your Instagram and Facebook accounts through Meta's official APIs to facilitate timely responses to direct messages, comments, and story replies on your behalf.

The Service includes conversation management, response tools, analytics, and reporting.

To use the Service, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Own or have explicit authorization to manage the Instagram/Facebook accounts you connect
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account

You are responsible for:

• All activity that occurs under your account
• Ensuring your use complies with all applicable laws and regulations
• The content and accuracy of information you provide to configure AI responses
• Reviewing and approving responses sent on your behalf
• Maintaining proper authorization for all connected social media accounts

You agree not to use the Service to:

• Send spam, unsolicited messages, or bulk automated messages
• Harass, threaten, or abuse any individual
• Violate Meta's Platform Terms, Community Standards, or Developer Policies
• Impersonate any person or entity
• Distribute malware, phishing links, or harmful content
• Engage in any illegal activity
• Violate the intellectual property rights of others
• Attempt to circumvent platform rate limits or restrictions

Violation of these acceptable use terms may result in immediate suspension or termination of your account.

The Service, including its design, features, and underlying technology, is owned by SellByChat.ai and protected by intellectual property laws. You retain ownership of the content you provide to us, including system prompt configurations and business information.

You grant us a limited license to use your content solely for the purpose of providing the Service.

Paid plans are billed on a recurring basis as described at the time of purchase. You agree to pay all fees associated with your selected plan. We reserve the right to change pricing with 30 days notice.

Refunds are handled on a case-by-case basis. Contact support@sellbychat.ai for billing inquiries.

To the maximum extent permitted by law, SellByChat.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

You are responsible for monitoring and reviewing interactions conducted through the Service on your behalf.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

Either party may terminate this agreement at any time. You may cancel your account by contacting support@sellbychat.ai.

We may suspend or terminate your account immediately if you violate these Terms, engage in prohibited use, or if required by law or by Meta's platform policies.

Upon termination, your right to use the Service ceases immediately. Data deletion follows the timeline described in our Privacy Policy.

You agree to indemnify and hold harmless SellByChat.ai, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

These Terms are governed by and construed in accordance with the laws of Canada. Any disputes arising from these Terms or the Service shall be resolved in the courts of Canada.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
